Se propone una lectura de los textos del filósofo chileno Carlos Ruiz Schneider que presta atención a las citas que contiene y asume que éstas exceden su uso ilustrativo y autorizador, para funcionar como modo de expresión estético-político de un pensar filosófico comprometido con una democracia radical. Para ello se proyectan y reformulan categorías de análisis de crítica cultural y artística extraídas del trabajo de Nelly Richards (complementadas con aportes de la filosofía contemporáneas: Heidegger, Derrida, Foucault y Butler), pertinentes para (...) configurar lo que podría denominarse un ‘estilo epocal’ en el pensamiento crítico chileno de fines del siglo XX. We present an epistemological schema of natural sciences inspired by Peirce's pragmaticist view, stressing the role of the \emph{phenomenological map}, that connects reality and our ideas about it. The schema has a recognisable mathematical/logical structure which allows to explore some of its consequences. We show that seemingly independent principles as the requirement of reproducibility of experiments and the Principle of Sufficient Reason are both implied by the schema, as well as Popper's concept of falsifiability. We show that the schema has (...) some power in demarcating science by first comparing with an alternative schema advanced during the first part of the 20th century which has its roots in Hertz and has been developed by Einstein and Popper. Further, the identified differences allow us to focus in the construction of Special Relativity, showing that it uses an intuited concept of velocity that does not satisfy the requirements of reality in Peirce. While the main mathematical observation connected with this issue has been known for more than a century, it has not been investigated from an epistemological point of view. A probable reason could be that the socially dominating epistemology in physics does not encourage such line of work. We briefly discuss the relation of the abduction process presented in this work with discussions regarding ``abduction'' in the literature and its relation with ``analogy''. (shrink)

El presente texto contiene los resultados de una revisión bibliográfica realizada con el objetivo de establecer la importancia de desarrollar competencias emocionales durante el proceso de formación de los profesionales de la salud, especialmente del área de odontología, atendiendo a que la especialidad está registrada como una de las profesiones más estresantes, situación que podría originarse durante el proceso educativo, ya que sus alumnos experimentan altos niveles de ansiedad o estrés durante su formación. Se entiende por competencia emocional el conjunto (...) de conocimientos, capacidades, habilidades y actitudes necesarias para comprender, expresar y regular los fenómenos emocionales. Como conclusión, esta revisión permitió demostrar como la inclusión de estas competencias en el plan de estudios repercutiría significativamente en el bienestar psicológico de estos estudiantes. This paper contains the results of a bibliographical review which was carried out aiming at establishing the importance of developing emotional competence in health professionals' training, especially on the dentistry area; providing that this specialty is one of the most stressful. The educational process might be at the root of this situation, since students experience high levels of anxiety or stress during their training. Emotional competence is understood as the group of knowledge, abilities and attitudes needed to understand, express and regulate emotional phenomena. In conclusion, this review enabled to demonstrate how the inclusion of emotional competence in dentistry major's syllabus would have an influence on student's psychological well-being. (shrink)

This paper addresses two subject matters. The first one is a parallel between the conceptions of democracy and university developed by Jaime Guzmán and Jorge Millas in the historical context surrounding 1973’s military strike. It serves as a documentary point of reference an exchange between Guzmán and Millas at the editorial pages of El Mercurio paper during the summer of 1976. The other subject matter is the configuration of the post-military strike philosophical field, as system of rules and strategies of (...) enunciation. The Guzmán-Millas transaction enables to see how the rules of the philosophical field are tied with models of university and democracy imposed by the post-strike State. (shrink)

Abstract We examine the construction of electromagnetism in its current form, and in an alternative form, from a point of view that combines a minimal realism with strict rational demands. We begin by discussing the requests of reason when constructing a theory and next, we follow the historical development as presented in the record of original publications, the underlying epistemology (often explained by the authors) and the mathematical constructions. The historical construction develops along socio-political disputes (mainly, the reunification of Germany (...) and the second industrial revolution), epistemic disputes (at least two demarcations of science in conflict) and several theories of electromagnetism. Such disputes resulted in the militant adoption of the ether by some, a position that expanded in parallel with the expansion of Prussia. This way of thinking was facilitated by the earlier adoption of a standpoint that required, as a condition for understanding, the use of physical hypothesis in the form of analogies; an attitude that is antithetic to Newton's “hypotheses non fingo”. While the material ether was finally abandoned, the epistemology survived in the form of “substantialism” and a metaphysical ether: the space. The militants of the ether attributed certainties regarding the ether to Faraday and Maxwell, when they only expressed doubts and curiosity. Thus, the official story is not the real history. This was achieved by the operation of detaching Maxwell's electromagnetism from its construction and introducing a new game of formulae and interpretations. Large and important parts of Maxwell work are today not known, as for example, the rules for the transformation of the electromagnetic potentials between moving systems. When experiments showed that all the theories based in the material ether were incorrect, a new interpretation was offered: Special Relativity (SR). At the end of the transformation period a pragmatic view of science, well adapted to the industrial society, had emerged, as well as a new protagonist: the theoretical physicist. The rival theory of delayed action at distance initiated under the influence of Gauss was forgotten in the midst of the intellectual warfare. The theory is indistinguishable in formulae from Maxwell's and its earlier versions are the departing point of Maxwell for the construction of his equations. We show in a mathematical appendix that such (relational) theory can incorporate Lorentz' contributions as well as Maxwell's transformations and C. Neumann's action, without resource to the ether. Demarcation criteria was further changed at the end of the period making room for habits and intuitions. When these intuited criteria are examined by critical reason (seeking for the fundaments) they can be sharpened with the use of the Non Arbitrariness Principle, which throws light over the arbitrariness in the construction of SR. Under a fully rational view SR is not acceptable, it requires to adopt a less demanding epistemology that detaches the concept from the conception, such as Einstein's own view in this respect, inherited from Hertz. In conclusion: we have shown in this relevant exercise how the reality we accept depends on earlier, irrational, decisions that are not offered for examination but rather are inherited from the culture. Instead of addressing Newton’s equations as a set of axioms, ultimately given by the revelation of a prodigious mind, we search for the fundamental knowledge, beliefs and provisional assumptions that can produce classical mechanics. We start by developing our main tool: the no arbitrariness principle, that we present in a form (...) that is apt for a mathematical theory as classical mechanics. Subsequently, we introduce the presence of the observer, analysing then the relation objective–subjective and seeking objectivity going across subjectivity. We take special care of establishing the precedence among all contributions to mechanics, something that can be better appreciated by considering the consequences of removing them: the consequence of renouncing logic and the laws of understanding is not being able to understand the world, renouncing the early elaborations of primary concepts such as time and space leads to a dissociation between everyday life and physics, the latter becoming entirely pragmatic and justified a-posteriori, changing our temporary beliefs has no real cost other than effort. Finally, we exemplify the present approach by reconsidering the constancy of the velocity of light. It is shown that it is a result of Newtonian mechanics, rather than being in contradiction with it. We also indicate the hidden assumption that leads to the contradiction. (shrink)

The embodied simulation of smiles involves motor activity that often changes the perceivers' own emotional experience (e.g., smiling can make us feel happy). Although Niedenthal et al. mention this possibility, the psychological processes by which embodiment changes emotions and their consequences for processing other emotions are not discussed in the target article's review. We argue that understanding the processes initiated by embodiment is important for a complete understanding of the effects of embodiment on emotion perception.

A simple model for the description of atomic and ionic species with spectra exhibiting a quantum defect is solved using the Lie algebra su(1, 1). The quantum defect of bound states is related to the phase shift of scattering states. The resonances are discussed in terms of the nonunitary representations of this algebra.

We study envy-free allocations in a many-to-many matching model with contracts in which agents on one side of the market (doctors) are endowed with substitutable choice functions and agents on the other side of the market (hospitals) are endowed with responsive preferences. Envy-freeness is a weakening of stability that allows blocking contracts involving a hospital with a vacant position and a doctor that does not envy any of the doctors that the hospital currently employs. We show that the set of (...) envy-free allocations has a lattice structure. Furthermore, we define a Tarski operator on this lattice and use it to model a vacancy chain dynamic process by which, starting from any envy-free allocation, a stable one is reached. (shrink)

Whole eye transplantation (WET) remains experimental. Long presumed impossible, recent scientific advances regarding WET suggest that it may become a clinical reality. However, the ethical implications of WET as an experimental therapeutic strategy remain largely unexplored. This article evaluates the ethical considerations surrounding WET as an emerging experimental treatment for vision loss. A thorough review of published literature pertaining to WET was performed; ethical issues were identified during review of the articles.

Through theoretical discussion, literature review, and a computational model, this paper poses a challenge to the notion that perspective-taking involves a fixed architecture in which particular processes have priority. For example, considerable work has shown that egocentric perspectives can arise more quickly, with other perspectives (such as of task partners) emerging only secondarily. This theoretical dichotomy is challenged here, and we propose a general view of perspective-taking as an emergent phenomenon governed by the interplay among several cognitive mechanisms. We first (...) describe the pervasive relevance of perspective-taking to cognitive science. A dynamical systems model is then introduced which explicitly formulates the timescale interaction proposed. Implications are discussed, with ideas for future empirical research. (shrink)

Content-based authorship identification is an emerging research problem in online social media networks, due to a wide collection of issues ranging from security to privacy preservation, from radicalization to defamation detection, and so forth. Indeed, this research has attracted a relevant amount of attention from the research community during the past years. The general problem becomes harder when we consider the additional constraint of identifying the same false profile over different social media networks, under obvious considerations. Inspired by this emerging (...) research challenge, in this paper we propose and experimentally assess an innovative framework for supporting content-based authorship identification and analysis in social media networks. Schools have been the main context for physical activity and sedentary behavior interventions among adolescents, but there is inconsistent evidence on whether they also improve dimensions of the health−related quality of life. The aim of this study was to evaluate the effects of a school-based active lifestyle intervention on dimensions of HRQoL. A secondary aim was to verify whether sex, age, and HRQoL at baseline were moderators of the intervention effect. A cluster-randomized controlled trial was conducted at three control and (...) three intervention schools in Florianopolis, Brazil. All students from 7th to 9th grade were invited to participate. A school year intervention, designed primarily to increase PA and reduce SB, included strategies focused on teacher training on PA, SB, and nutrition, and availability of teaching materials related to these contents; environmental improvements ; and education strategies, with the availability of folders and posters regarding PA, SB, and nutrition. Participants and the research staffs were not blinded to group assignment, but a standardized evaluation protocol was applied at baseline and after the intervention using the KIDSCREEN−27 to assess HRQoL across five dimensions. Mixed linear models were performed to evaluate the effect of the Movimente intervention on the five HRQoL dimensions. Of the 921 students who answered the questionnaire at baseline, 300 and 434 completed the study in control and intervention groups, respectively. The results revealed no significant effects of the intervention on any HRQoL dimensions. A reduction of the school environment dimension was observed in both the control and intervention groups. Sensitivity analyses showed that students in the highest baseline tertiles of HRQoL in any dimension had a reduction in their respective scores from pre- to post-intervention in both school groups. In conclusion, our results demonstrated no intervention effect on HRQoL dimensions and those students with the highest levels of HRQoL at baseline on all dimensions reduced from pre to post-intervention.Clinical Trial RegistrationThe trial is registered at the Clinical Trial Registry. Let G V, E be a simple undirected complete graph with vertex and edge sets V and E, respectively. In this paper, we consider the degree-constrained k -minimum spanning tree problem which consists of finding a minimum cost subtree of G formed with at least k vertices of V where the degree of each vertex is less than or equal to an integer value d ≤ k − 2. In particular, in this paper, we consider degree values of d ∈ (...) 2,3. Notice that DC k MST generalizes both the classical degree-constrained and k -minimum spanning tree problems simultaneously. In particular, when d = 2, it reduces to a k -Hamiltonian path problem. Application domains where DC k MST can be adapted or directly utilized include backbone network structures in telecommunications, facility location, and transportation networks, to name a few. It is easy to see from the literature that the DC k MST problem has not been studied in depth so far. Thus, our main contributions in this paper can be highlighted as follows. We propose three mixed-integer linear programming models for the DC k MST problem and derive for each one an equivalent counterpart by using the handshaking lemma. Then, we further propose ant colony optimization and variable neighborhood search algorithms. Each proposed ACO and VNS method is also compared with another variant of it which is obtained while embedding a Q-learning strategy. We also propose a pure Q-learning algorithm that is competitive with the ACO ones. Finally, we conduct substantial numerical experiments using benchmark input graph instances from TSPLIB and randomly generated ones with uniform and Euclidean distance costs with up to 400 nodes. Our numerical results indicate that the proposed models and algorithms allow obtaining optimal and near-optimal solutions, respectively. Moreover, we report better solutions than CPLEX for the large-size instances. Ultimately, the empirical evidence shows that the proposed Q-learning strategies can bring considerable improvements. En esta trabajo se analiza la relación existente entre las propuestas de Mendel, de los "redescubridores" -de Vries, Correns y Tschermak-, de Bateson y colaboradores y de Morgan y discípulos, e.e. la historia de la genética "clásica", en términos de "inconmensurabilidad", de forma tal de capturar y precisar tanto la idea de que entre éstas se dan ciertas discontinuidades y rupturas como de que éstas tienen "algo" que ver de algún modo entre sí. En particular, se introducen, con ayuda del (...) marco conceptual de la metateoría estructuralista, y aplican al presente caso, los conceptos de "inconmensurabilidad teórica" y "comparabilidad empírica". In this paper the existing relationship between the proposals of Mendel, the "rediscoverers" -de Vries, Correns and Tschermak-, Bateson and collaborators and Morgan and disciples, e.g. the history of "classical" genetics is analyzed in terms of "incommensurability", in such a way to capture and to precise so much the idea that among them take place some discontinuities and ruptures as well as that they have "something" to do with each other. In particular, the concepts of "theoretical incommensurability" and "empirical comparability" are introduced with the help of the conceptual framework of the structuralist view of theories and applied to this case. Badiou called the“French philosophical moment”, the relationship between Simondonian concepts and some currents ofthought today and, finally, the way in which these notions are intertwined within the framework of the general theoryof individuation and the technics of the French philosopher. These three axes refer to the need to elaborate a philosophythat is contemporary with the questions posed by its time. On a prominent family of views about the justification of legitimate policy-making (_public justification views_), considerations about the rights and well-being of nonhuman animals can only play a derivative role at best. On these views, these considerations matter only if they can figure in the content of the public reasons that citizens can offer each other. This thesis I call the Indirect View. Some authors have argued that this constitutes a reason to reject the ideal of public justification, or at (...) least to qualify it. It is unclear, however, whether public justification theorists will be persuaded by this. In this paper, I argue that they should. In order to do so, I focus on three justifications of the ideal of public justification that have been offered in the literature (justice, our reactive attitudes, and civic friendship), and contend that none of them supports the Indirect View. In some cases, this is because the value in question (e.g. justice) might indeed be extended to animals. In other cases, this is because there is often a trade-off between the values in play and considerations about the rights and well-being of animals in which the former do not always outweigh the latter. ABSTRACT The controversy over prejudices is a distinctive feature ofthe German Enlightenment. The article addresses some historical aspects of this controversy that are useful to shed light on Kant's thought. Enlightenment positions ranged from the perspective seeking to rid itself of all prejudices, to that which allows for some prejudices and even considers them useful. The article argues that the Kantian position on the matter constitutes an effort to reconcile these perspectives, thus anticipating the distinction set forth in the "Transcendental Dialectic" between the regulative and the constitutive use of ideas. What happens when we are uncertain about what we want, feel or whish for? How should we understand uncertainty in introspection? This paper reconstructs and critically assess two answers to this question frequently found in the secondary literature on Wittgenstein: indecision and self-deception (Hacker 1990, 2012; Glock 1995, 1996). Such approaches seek to explain uncertainty in introspection in a way which is completely distinct from uncertainty about the ‘outer world’. I argue that in doing so these readings fail to account (...) for the substantial role the intellect seems to play in the process of resolving such uncertainties. I then attempt to show that Wittgenstein’s remarks connecting psychological vocabulary, behaviour and public criteria (e. g. PI 2009: 580) provide alternative ways for thinking about uncertainty in introspection which allow for a substantial role of the intellect. (shrink)

In “Willpower with and without effort”, G. Ainslie advances our understanding of selfcontrol by theoretically unifying multiple forms of willpower. But one crucial question remains unanswered: How do agents pick the right forms of willpower in each situation? I argue that willpower requires tactical skill, which detects willpower-demanding contexts, selects context-appropriate tactics, and monitors their implementation. Research on tactical skill will significantly advance our understanding of willpower.

This paper examines Gilles Deleuze’s reading of Immanuel Kant’s “Critique of the Aesthetic Power of Judgment”. We will show a) that the author holds an interpretative thesis according to which the third Kantian Critique would not be a complement but rather a foundation of the previous ones, inasmuch as the determined agreements of the first two Critiques presuppose the possibility of an indeterminate agreement between the faculties; b) that the demand for a genesis of the sensus communis by Deleuze can (...) be summed up in three requisites: discordance, contingency, and vivification; and c) in which senses Deleuze considers that the aforementioned requirements are satisfied in the Kantian text. En este trabajo analizo la autonomía y relevancia normativa de las normas permisivas. En especial, mis propósitos principales son revisar dos tesis escépticas: los permisos y las normas permisivas pueden reducirse a otras formas normativas, e.g. derogación de prohibiciones, y no se producen diferencias significativas cuando se permite una conducta que no había sido previamente regulada. Ambas tesis son examinadas en relación a la naturaleza y función del principio de clausura normativa. La conclusión de este trabajo es que las normas (...) permisivas, y en particular las normas de clausura, pueden cumplir una importante función en los sistemas normativos y son una herramienta útil para analizar otros problemas como las lagunas del derecho y la discreción judicial. Judgments vary in the extent to which they are based on interpretation versus relatively direct access to mental contents. That is, a judgment might require a trivial amount of interpretation (e.g., translating one's immediately accessible ) or a rather substantial amount of confabulation. Recognizing this continuum of interpretation underlying judgment could be more fruitful than debating a categorical introspection versus interpretation distinction.

Introduction: Connectedness to nature is a concept that reflects the emotional relationship between the self and the natural environment, based on the theory of biophilia, the innate predisposition to the natural environment. However, the biophobic component has largely been ignored, despite, given its adaptive functional role, being an essential part of the construct. If there is a phylogenetic component underlying nature connectedness, biophilic and/or biophobic, there should be evidence of this record from early childhood. The main aim of this study (...) is therefore to describe the emotional attributions identified in five-year-olds. Methodology: Two studies were conducted. In the first, 94 children expressed their concept of nature and made basic emotional attributions to a set of 60 images of natural and urban environments, using a software designed for the study. In the second, 39 children repeated the procedure and provided explanations for their responses. Results: The main results show that, in general, children use both positive and negative emotions, which may be related to a three-dimensional model of emotional attributions to nature. The most widely attributed emotion is happiness, for the images of both natural and built environments. However, fear is the second most common attribution. The role of happiness could be explained by a feeling of security and familiarity that the habitat of the built environment contributes to, while the importance of fear in nature could show an adaptive response of the fear of wild nature in children. This interpretation could be confirmed when analyzing specifically the emotional attributions to the natural environment, classifying the images according to biological and ecosystemic criteria. Thus, for example, more emotional attributions are explained by the "pleasantness" attributed to primary producers and landscapes (e.g. flora), versus attributions of "harm" to the images of secondary and tertiary consumers (e.g. hunters). Conclusions: These results provide evidence in favor of a didactic procedure to study emotional attributions to images of nature in preschool children. They suggest the incorporation of biophobia as an important adaptive factor in connectedness to nature and a tripartite emotional hypothesis based on the valences of the attributed emotions. Una forma clásica de explicar el significado de una oración es establecer sus condiciones deverdad. Sin embargo, dado que sólo las oraciones declarativas encajan con este tipo de análisis, las oraciones (e.g. imperativas) que carecen de valor de verdad quedan fuera de este análisis. Con el objeto de evitar esta dificultad, algunas veces se ha sugerido que el cumplimiento de un imperativo les el valor semántico de I, y que este valor depende del concepto de verdad. En este artículo, explicamos (...) esta sugerencia mediante un lenguaje artificial: el lenguaje LN. Nuestra propuesta consiste en suministrar una reconstrucción del concepto de eficacia a partir de la relación de cumplimiento, analógamente a la reconstrucción del concepto de verdad a partir de la relación de satisfacción. Nuestras conclusiones principales son las siguientes: 1) el significado de una oración imperativa es establecido por sus condiciones de eficacia y 2) esta teoría del significado de los imperativos suministra una base semántica, adeucada para la lógica deóntica.A classical way of explaining the meaning of certain sentences is to establish their truth-conditions. However, since only declarative sentences fit this kind of analysis, sentences (e.g. imperatives) which lack truth-value remain outside the theory of meaning. In order to avoid this difficulty, it is sometimes suggested both that compliance with an imperative I is the semantic value of I, and that this value is dependent on the concept of truth. In this article, we explain this suggestion with the help of a constructed language: the artificial language NL. Our proposal Is to provide a reconstruction of the concept of effectiveness from the relation of compliance, on the analogy of the reconstruction of the concept of truth from the relation of satisfaction. Our main conclusions are: 1) the meaning of a imperative sentence would be established by its effectiveness-conditions and 2) this theory of meaning of imperatives would provide a semantic basis, suitable to the deontic logic. The issue of what constitutes a valid logical inference is a difficult question. At a minimum, we believe a permissible step in a proof must provide the reader with rational grounds to believe that the new step is a logically necessary consequence of previous assertions. However, this begs the question of what constitutes these rational grounds. Formalist accounts typically describe valid rules of inferences as those that can be found by applying one of the explicit rules of inference in the (...) formal system in which the proof is couched. However, philosophers of mathematics find such a description unhelpful because many inferences in the proofs that mathematicians actually produce cannot be expressed in a formal language, at least not without seriously distorting the semantic content of the inference (e.g., Larvor, 2012). In this chapter, we investigate mathematicians’ perceptions of a particular kind of inference in a particular setting. Specifically, we shed light on what types of graphical inferences mathematicians find permissible in a real analysis proof. Following Larvor (in press), we examine mathematicians’ reactions to metrical graphical inferences (i.e., inferences whose validity depends on the accuracy of the graph that was drawn and whose validity can be changed by minor deformations) and nonmetrical graphical inferences (i.e., inferences whose validity does not depend on a the accuracy of the graph and whose validity is not vulnerable to local deformations). The goal of this chapter is threefold. First, we demonstrate that most mathematicians reject metrical graphical inferences as impermissible in a real analysis proof. Second, we show that many mathematicians regard nonmetrical graphical inferences as permissible in a real analysis proofs. Third, we illustrate how mathematicians collectively disagree on the permissibility of nonmetrical inferences. (shrink)

Plurality implies a public sphere in which different worldviews (e.g. Secular Humanist, Christian, Jewish, Muslim and others) coexist respecting each other. Banning the presence of one or several of them from the public sphere is questionable in principle, and divisive in practice.

Higher education institutes both foster the advancement of knowledge and address society's socioeconomic and environmental challenges. To fulfil these multiple missions requires significant changes to how the role of a researcher is perceived e.g. a researcher identity that is congruent with the objective of contributing to fundamental knowledge while also engaging with non-academic actors, broadly, and entrepreneurship, in particular. We argue that the early stages of an academic career—namely the PhD training trajectory—and the knowledge networks formed during this period have (...) a major influence on the scientist’s future capacity to develop an appropriate researcher role identity. We draw on knowledge network and identity theories to investigate how the knowledge networks (i.e. business, scientific and career knowledge networks) of PhD students promote changes to, reinforce or conflict with the perception of a researcher role identity. Our longitudinal qualitative network study includes PhD students and their supervisors funded by the H2020 FINESSE project. At the network level, we show that scientific knowledge is distributed equally throughout young academics’ networks but that entrepreneurial (business) and career knowledge tend to be concentrated around certain individuals in these networks. On the PhD student level, we observe different pronunciations of the researcher role identity linked to students’ interactions with their knowledge networks. We distinguish identity conflicts due to misalignment between ego and alters which leads to withdrawal from the network. Our findings have practical implications and suggest that universities and PhD student supervisors should support PhD students to develop a researcher identity which is in line with the individual PhD student’s expectations. En "Legal Reasons, Sources and Gaps", Raz señala que las lagunas jurídicas existen sólo cuando el derecho habla con voz incierta o cuando habla con muchas voces, pero que no hay lagunas cuando el derecho guarda silencio. En este último caso habría reglas de clausura, analíticamente verdaderas, que impiden la ocurrencia de esas lagunas. Según Raz, si hay una laguna en un sistema jurídico, entonces no es verdadero ni falso que exista una razón concluyente para ejecutar cierta acción. Así, una (...) de las contribuciones más importantes de Raz a la solución del problema de las lagunas jurídicas es subrayar que el discurso jurídico no está completamente controlado por la bivalencia. Sin embargo, a menudo se sostiene que el rechazo de la bivalencia conduce a contradicciones. Si esta afirmación fuese verdadera, entonces la solución de Raz al problema de las lagunas jurídicas se vería seriamente amenazada. En este artículo mostramos, con ayuda de una herramienta analítica sofisticada, i.e., la lógica de la verdad de G.H. von Wright, que el rechazo de la bivalencia sólo nos compromete a aceptar la conclusión trivial de que puede haber proposiciones que no son verdaderas ni falsas. Por esta razón, el trabajo de Raz todavía puede ser considerado un buen punto de partida para analizar las relaciones entre normas, razonamiento práctico y lagunas jurídicas. Sin embargo, también mostramos que para admitir proposiciones que no son verdaderas ni falsas, las tesis de Raz deben ser reformuladas. De otra manera, la tesis de que no existen lagunas cuando el derecho guarda silencio no sería compatible con el rechazo de la bivalencia. /// In his paper "Legal Reasons, Sources and Gaps", Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principie of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show--with the aid of a sophisticated analytical tool, i.e., von Wright's truth-logic--that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth-values. For this reason, Raz's paper can still be regarded as a good starting-point for analyzing the relationships between norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

El artículo estudia el fragmento de una carta de Prisciliano recogida en el "Commonitorium de errore priscillianistarum et origenistarum" de Pablo Orosio, para recolocar el fragmento en el contexto orosiano. Posteriormente se estudia el fragmento en el contexto de las fuentes priscilianas, para ver si se puede hacer un acercamiento con las ideas de los "Tratados de Wurzburg", y las de E.-Ch.Babut y E. Spät principalmente.
